Terms of Use

Effective: October 2, 2026

These Terms of Use ("Terms") are a legal agreement between you and Carl Franzon ("we", "us") for WakePlan (the "App"). They are concluded between you and us only, not with Apple. We, not Apple, are solely responsible for the App and its content. These Terms do not conflict with the Apple Media Services Terms and Conditions.

By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

License

We grant you a limited, non-exclusive, non-transferable license to use the App on any Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The App may also be accessed via Family Sharing, volume purchasing, or Legacy Contacts where Apple allows that. The license is for personal, non-commercial use unless we agree otherwise in writing.

Maintenance and support

We are solely responsible for providing any maintenance and support for the App, as described in these Terms or as required by law. You and we acknowledge that Apple has no obligation to furnish any maintenance or support services for the App. For support, use the contact details below.

Subscriptions and payment

  • The App may offer auto-renewing subscriptions billed through your Apple ID.
  • Payment is charged to your Apple ID at confirmation of purchase.
  • Subscriptions renew unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Your account is charged for renewal within 24 hours prior to the end of the current period, at the then-current renewal price shown at purchase.
  • Manage or cancel in Settings > Apple ID > Subscriptions.
  • Any unused portion of a free trial is forfeited when you purchase a subscription.
  • Title, length, and price of each subscription are shown in the App's purchase screen and in App Store Connect. Those screens control if they differ from this summary.
  • Billing, taxes, and refunds for App Store purchases are handled by Apple under Apple's terms. Request refunds through Apple, not from us, unless the law says otherwise.

Acceptable use

You agree not to misuse the App, attempt to reverse-engineer it except where the law allows, or use it in a way that violates applicable law or infringes others' rights.

Your content and storage

Contexts, wake-time preferences, calendar rules, and overrides you create are used locally on your device and may be backed up or synced when iCloud is available, through Apple's iCloud key-value storage under your Apple account. A new device that finds a backup during onboarding can restore it or start fresh; a device that started fresh can later reconnect in Settings, which overwrites the iCloud backup. Plan summaries are shared with your paired Apple Watch and widgets. Google Calendar sign-in credentials are kept in a device-only Keychain and may survive deleting the App; use Disconnect in the App (before deleting, or after reinstalling) and revoke access in your Google Account to remove access. Deleting the App does not delete iCloud data or device backups. The App does not accept publicly shared user-generated content. You are responsible for keeping backups you care about.

Disclaimer of warranties

To the maximum extent permitted by applicable law, the App is provided "as is" and "as available" without warranties of any kind, whether express or implied. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed.

If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the Licensed Application to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are our sole responsibility.

Nothing in these Terms limits any non-waivable consumer rights you have under the law of your country of residence (including in the EU/EEA and the UK).

Limitation of liability

To the maximum extent permitted by applicable law, Carl Franzon's total liability for any claim relating to the App will not exceed USD 50 or the amount you paid for the App in the 12 months before the claim, whichever is greater. These Terms do not limit our liability to you beyond what applicable law allows, including liability for death or personal injury caused by negligence, fraud, or other liability that cannot legally be limited.

Product claims

You and we acknowledge that we, not Apple, are responsible for addressing any claims by you or any third party relating to the App or to your possession and/or use of the App, including: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with any use of HealthKit or HomeKit.

Intellectual property claims

If a third party claims that the App, or your possession and use of the App, infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement, and discharge of that claim.

Legal compliance

You represent and warrant that (i) you are not located in a country or region that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country or region; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Third-party terms

You must comply with applicable third-party terms when using the App, including Apple's terms, your wireless data service agreement, and Google's terms if you connect Google Calendar.

Termination

We may suspend or terminate your access to the App if you violate these Terms. You may stop using the App at any time and delete it. Provisions that by their nature should survive (including licence restrictions, disclaimers, liability limits, and Apple's third-party beneficiary rights) survive termination.

Governing law

These Terms are governed by the laws of Sweden, without regard to conflict-of-law principles. If you are a consumer, you may also benefit from mandatory protections of the law of your country of residence, and you may bring proceedings in your local courts where the law gives you that right.

Apple as third-party beneficiary

You and we acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
